
Online Jurisdiction
The rules governing jurisdiction were well defined prior to the
Internet, but now jurisdiction has become a complex issue that is of
paramount importance to business owners.
For example, imagine that you own a small company that
manufacturers widgets. Before the Internet, you sold them locally
and if an issue arose with a customer, that customer would address
this issue in the local court and it would be resolved. Now imagine
you own this same manufacturing company, but now you sell your
widgets online over the Internet and someone 1500 miles away buys
your widget. If they have an issue with it, they are not likely to
want to come to your state to litigate the issue, so all of the
sudden you may be subject to personal jurisdiction in every locality
where you sell your widgets!
The above example is just one of the dozens of ways that the
